(a) In General
395.0040 Property Not Ordinarily Sold by Permittee. A sale of property of a type not ordinarily sold by a permittee can be regarded as an exempt occasional sale under section 6006.5(a) only when it is made by him in an individual capacity and it is unrelated to his sales activity. 8/24/64; 2/24/98.
